1. Introduction

BlastRoom ("we", "our", "us") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our service.

2. How to Submit a Takedown Notice

If you believe that content hosted on BlastRoom infringes your copyright, please send a written notification that includes the following information (as required by Section 512(c)(3) of the DMCA):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (e.g., a URL or description of where the content appears on BlastRoom).
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

Please allow up to 2 business days for us to process your request. We will remove or disable access to the infringing material promptly upon receipt of a valid notice.

4. Counter-Notification Process

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our copyright agent. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original notification.

Upon receipt of a valid counter-notification, we will forward it to the complaining party and restore the removed material within 10 to 14 business days, unless the copyright owner files a court action against you.

5. Repeat Infringer Policy

In accordance with the DMCA, BlastRoom will terminate, in appropriate circumstances, the accounts of users who are repeat infringers. We may also limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. Good Faith

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Please do not make false claims.
